Being art does not instantly give you freedom to use nazi imagery liberally, but specific examples can be looked at to see if it's appropriate. Video games were not originally granted this exception due to it being seen as toys rather than art since that's really what they were when gaming was still so young. This is basically Germany recognizing that games can be art as well.
