First for Hilary the investigation was thoroughly done. It in the past and not related to Comey's testimony. I understand you and many others didn't like his conclusion but it's what it is.
As for the first part of your question. Comey's is an experienced prosecutor. If he states anything about his opinion at this point it could undermine his testimony or credibility "in the face of law" He act like the perfect witness. States facts, not opinion. And he is absolutely right to do so. (In his own interest.) It's not to him to judge if it was obstruction of justice. On the other end it was his call to say if there was enough (if any) evidence to submit Clinton's case to the Department of Justice. I know not everyone agree with that part but that's how it work. (Here in Québec at least.) Not every investigations results are turned to dept. of Justice. (The "DPCP" in our case.)
Once again. You may not agree with with his decisions. You may not like the guy. (Can't say I'm a fan myself.) But he knows what he's doing.
Which bring me to the "leaked" memos... Apparently I'm the only one who remember only the first one to be written on a FBI laptop. Including "liberal" media so... idk... Maybe I was wrong about that? I know, it's shocking. You'll recover! Anyways. It was his personal recollection and was transmitted while he was a private citizen so... What you wanna do about that? Erase his memory? As I said. Like him or not you have to admit the guy is good and knows his business. I'm pretty sure he knew what he was doing. Enough to not even try to hide what he had done.

Another thing a lot of people are talking about is why didn't Comey told Trump he shouldn't be asking stuff like that. That's where I think Comey wasn't 100% honest. One(s) of the few moments where he hesitated before answering. Beside those he had to say. "Not in public". My opinion, and its my opinion only, is his professional reflexes kicked in. Cops, investigators, prosecutors, lawyers, border agents, name it. They all hide a raptor inside. They see someone digging his own hole . Say nothing, do nothing. Let him dig and take notes. That's exactly what he said he did.
Trump first big mistake was to threaten Comey with "tapes" story. Now he better shut up and pray for the best. But no. His lawyer said he want to file a complaint... I wouldn't do that. Comey breath laws, court and prosecution. He dedicated his entire life to it and his good. Really good. Don't challenge the guy in his own playground.
